Konstanz A Kuraz, J.D., Mediator and Owner, received extensive mediation training in Iowa before opening and operating her own mediation practice in Cedar Falls, Iowa, where she mediated a broad range of disputes. After relocating to Arizona, the Yavapai County Superior Court employed her as a mediator who specialized in creating family parenting plans and resolving civil property disputes before she founded The Mediation Advantage, P.L.L.C.
Konstanz received her Law Degree from the University of Iowa College of Law. Honored with numerous awards, she graduated summa cum laude from Northern Iowa where she majored in Philosophy and minored in Ethics and Leadership Studies. Konstanz is an international traveler, human rights scholar, and published author. Enthusiastic, empowering, and patient, she is known for her creative approaches to conflict resolution. These include her ability to relate to others, analyze complicated issues, address difficult emotions, and create bridges of understanding that can lead to peaceful resolutions.
Kathy Howe, Mediator, has experience mediating for the Maricopa County Court system, working primarily for Judge Michael Reagan’s Court McDowell Mountain. She also mediated for Dreamy Draw, Desert Ridge, East Mesa, Moon Valley, and the Downtown Justice Court. Kathy was first trained on the Big Island of Hawaii where she also did court mediations.
Kathy owns and operates an AZ Department of Real Estate School in Sedona, www.how2educate L.L.C., which trains individuals for their salesperson license and broker license and gives continuing education classes to existing agents, including Code of Ethics training. Kathy is great at negotiations and prefers to do real estate or other business related mediations where she can assist parties in crunching the numbers. Kathy specializes in Real Estate HOAs and Landlord Tenant mediation issues.

WHAT WE DO:
We help you to transform your conflict from a negative and destructive interaction to a positive and constructive one.
There are many ways to resolve conflicts—surrendering, running away, overcoming with manipulation and control, overpowering with violence, filing a lawsuit, etc. The inspiration that led to the movement called Alternative Dispute Resolution (ADR) grew out of the belief that there are other options than using violence or going to court. Mediation is the most commonly used form of ADR and is the service most requested by members of the public.
HOW WE DO IT:
Acting as third party neutrals, we help parties in mediation to create their own solutions rather than telling them what to do. This is considered the “transformational” method of mediation.
Addressing conflicts through mediation usually takes less time and costs less money than litigation. Working in two hour blocks of time, we assist you in talking and listening to each other about what is important to you. Sometimes results can be accomplished in one session, but more than one session is usually required.
Each party in mediation is given the chance to make decisions that are acceptable to all concerned and to decide what to do next. This process fosters empowerment and the opportunity to be recognized and heard. It allows each party to maintain greater control over their lives. The result is often a better understanding of their situation. Compliance with agreements is recognized for being higher than with court imposed judgments. For example, although most are doubtful before they start, two thirds of couples who mediate in divorce or custody cases reach agreement on some or all issues.
A primary benefit to using mediation is privacy. We maintain strict confidentiality in mediation so that the parties can avoid public disclosure of sensitive information in the courts.
If decisions are made in mediation, we recommend that you review these decisions with an attorney. Because we are acting as third party neutrals, we cannot give legal advice to either party. Upon completion, we provide you with a written agreement, or Memorandum of Understanding, to be signed by each participant. This memorandum may be shared with attorneys or the court system. When a judge reads and signs your agreement, it will be entered as an enforceable order of the court.
